OFFICIAL RULES OF THE COMPETITION
“xBasket – Basketball Contest Champion 3”
Competition Period: April 1, 2024 (10:01 AM GMT+3) – August 1, 2024 (10:00 AM GMT+3)
SECTION 1. ORGANIZER OF THE COMPETITION
1.1 The organizer of the “xBasket – Basketball Contest Champion 3” competition (hereinafter referred to as the “Competition”) is X Dolla Games S.R.L. (hereinafter referred to as the “Organizer”), a commercial company registered in accordance with Romanian law, with its registered office located in Loc. Dealu Aluniş, City Berbeşti, Strada DANTULUI, Nr. 21, Block C38, Staircase A, 2nd Floor, Apt. 11, County Vâlcea, registered with the Trade Register under no. J38/647/21.07.2023, unique registration code RO 48526990.
1.2 Apple/Play Store are not sponsors of this competition and are not involved in this activity in any way.
1.3 The value of the prize is not wagered, awarded, or exponentiated based on game performance or chance outcomes.
SECTION 2. COMPETITION RULES
2.1 The competition will be conducted in accordance with the provisions of these regulations (“Regulations”), which are mandatory for all Participants and all entities involved in the conduct of the Competition.
2.2 The Regulations are drawn up and made public in accordance with the applicable legislation in Romania and are available, free of charge, to any participant, on https://x-dolla.games/termeni-si-conditii-concurs-xbasket-contest-editia-3/ in Romanian and in English on https://x-dolla.games/terms-and-conditions-of-the-xbasket-basketball-contest-edition-3/, as well as in the game where the competition takes place: “xBasket – Basketball Contest” (hereinafter referred to as the “Game”).
2.3 According to the Organizer’s free decision, the Competition may be publicized for the purpose of informing the public, including through advertising materials and/or with informative purposes. The information that such materials may contain will be interpreted in accordance with the provisions of these Regulations.
2.4 The Organizer reserves the right to modify and/or supplement the Regulations, as well as the right to suspend and/or terminate/interrupt the Competition, provided that Participants are notified in advance of any changes to any of its provisions. Any changes/supplements to the provisions of these Regulations will be included in additional documents communicated to the public by updating the Regulations and publishing them, in updated form, on https://x-dolla.games/termeni-si-conditii-concurs-xbasket-contest-editia-3/ in Romanian and in English on https://x-dolla.games/terms-and-conditions-of-the-xbasket-basketball-contest-edition-3/. Additionally, participants will be notified through the game.
2.5 Disqualifications will occur both during the contest and after the leaderboard snapshot. If there are any uncertainties from participants, the reasons for disqualification for each person can be obtained by contacting support@x-dolla.games.
SECTION 3. COMPETITION AREA AND DURATION
3.1 The competition is organized online, in accordance with the provisions of these Regulations, on the xBasket – Basketball Contest game for:

3.2 The competition takes place from April 1st (10:01 AM GMT+3) to August 1, 2024 (10:00 AM GMT+3).
SECTION 4. RIGHT TO PARTICIPATE
4.1 All participants (hereinafter referred to as “Players”) who have downloaded the xBasket – Basketball Contest game for Android or iOS for free and have registered an account with a nickname and email in the game’s leaderboard will automatically participate in the Contest without any fee.
4.2 Registration in the Competition implies the implicit, full, express, and unequivocal acceptance of the provisions of these Regulations.
4.3 The following categories of persons are not entitled to participate in this Competition:
(i) Persons who are not eligible according to Section 4.1;
(ii) Employees of the Organizer, as well as of the affiliated companies* of the Organizer;
(iii) Employees of Agency/Agency 2 or employees of any other companies/entities involved in activities related to the organization and conduct of the Competition;
(iv) Players who have chosen an indecent, racist nickname,
(v) Players who have attempted in any way to cheat (reverse engineering, change date, etc.).
(vi) Developers of this game.
4.4 The Organizer reserves the right to take all measures to prevent participation, as well as the right to remove from the Competition any person from the categories mentioned in Article 4.3.
SECTION 5. COMPETITION MECHANISM
5.1 For a valid registration for participation in the Competition, the following conditions must be cumulatively met:
a) The Player must have the right to participate in accordance with the provisions of Section 4 above;
b) A unique Player is identified based on the nickname in the game;
c) The Player must inform themselves in advance and in detail about any of the terms and conditions regarding the conduct of the Competition, in accordance with these Regulations;
d) The Organizer will ensure as much as possible that at the snapshot date, the first 3 players in the ranking are eligible to receive the prize.
e) Winners will be contacted via email and asked to provide their real name, bank details, and address for prize delivery.
f) Winners from the beginning of the first edition until now will have increased difficulty in the game to avoid monopolizing the prize due to the experience gained over previous editions.
g) It is mandatory to follow the Instagram account https://www.instagram.com/x_dolla_games/ at least 2 days before being designated as a potential winner in order to validate the prize.
5.2 All players will have 6 lives per day which they can use to score as many baskets as possible and earn the most points, points that will be indexed in a leaderboard (hereinafter referred to as the “Leaderboard”).
5.3. The Leaderboard will reset at the beginning of each month at 10:00 AM GMT+3.
5.4 Players who are ranked 1st on the leaderboard on the following calendar dates: May 1, June 1, July 1, August 1 (09:00 GMT+3) and who have met all participation conditions will be awarded prizes.
5.5 All inactive players for 30 days will be deleted from the database.
5.6 Players who have ever been awarded prizes during xBasket contests and reach the top 3 will be disqualified to ensure a fairer distribution of prizes to new players.
SECTION 6. COMPETITION PRIZES
6.1 Within the Contest, the following prizes will be awarded to the players ranked first each month:
a. On May 1st, the prize before taxes will be 1000 Lei (≈ 214 US Dollars). For Romanian residents, the tax will be 10% of the taxable value of 400 Lei, so the prize that will reach the winner will be 960 Lei (≈ 205 US Dollars). For non-residents whose country does not have a reciprocity treaty with Romania, the tax will be 16% of the taxable value of the prize.
b. On June 1st, the prize before taxes will be 1000 Lei (≈ 214 US Dollars). For Romanian residents, the tax will be 10% of the taxable value of 400 Lei, so the prize that will reach the winner will be 960 Lei (≈ 205 US Dollars). For non-residents whose country does not have a reciprocity treaty with Romania, the tax will be 16% of the taxable value of the prize.

For non-residents whose country does not have a reciprocity treaty with Romania, the tax will be 16% of the taxable value of the prize.
TOTAL PRIZE VALUE: 4000 Lei
6.2 The Organizer will not bear any additional expenses after awarding the winner the prize.
SECTION 7. ANNOUNCEMENT OF WINNERS AND AWARDING OF PRIZES
7.1 The prizes in the Contest will be awarded as follows:
At the beginning of each calendar month at 09:00 AM GMT+3, a snapshot of the Leaderboard will be taken, from which the data of the first Player + 2 reserves consisting of the 2nd and 3rd places will be extracted.
If the winning player does not respond to the email within 24 hours or has not met all the contest conditions, the player in 2nd place will be contacted. If the player in 2nd place also does not respond within 24 hours or has not met all the contest conditions, the player in 3rd place at the time of the snapshot will be contacted.
SECTION 8. VALIDATION AND PUBLICATION OF WINNERS. RECEIVING THE PRIZES
8.1 After the winners are announced, the Organizer will begin the validation process, during which the fulfillment of the conditions regarding the registration of the Participants will be verified, as well as compliance with all provisions of these Regulations.
8.2 The player who has been designated as the winner will be tagged in an Instagram story after it has been verified that they have followed the official organizer’s page https://www.instagram.com/x_dolla_games/ at least 2 days before the prize is awarded.
8.3 Participants who have been designated as winners will be contacted by the Organizer solely via email from the following email address contact@x-dolla.games, to request information used exclusively for the handing over of the prize (name, surname, banking details), tax data for withholding tax at source in accordance with Romanian tax regulations ~ “ART 223, para (1), letter m” & “art224 para.4 letter c1” & “art. 110 of the Fiscal Code approved by Law no. 227/2015, with subsequent amendments and completions” ~ (photo of the identity document), and they will be asked to complete an agreement for the transmission of this data in accordance with GDPR, and they must respond by email within 24 hours from the moment of contact.
8.4 The prizes will be sent via bank transfer or another online payment service. The Organizer will consult with the winner for the smoothest transmission of the prize.
8.5 In the event that, due to reasons beyond the Organizer’s control, one of the validated winners notifies the Organizer through the initial contact channels of their inability to participate or declines the prize after being informed of their win, the prize will not be awarded and will remain the property of the Organizer, who may dispose of it freely in a manner they deem necessary or suitable for their interests.
8.6 The Organizer has no obligation to correspond with potential winners or prize winners after the expiration of the deadlines provided in these Regulations, or with other participants outside the obligations assumed by these Regulations.
SECTION 9. TAXES AND FEES
9.1 The Organizer undertakes to calculate, withhold, declare, and pay the tax due for the incomes consisting of the prizes awarded to the winners in accordance with the provisions of art. 110 of the Fiscal Code approved by Law no. 227/2015, with subsequent modifications and completions, if applicable, any other obligations of any other nature, in connection with them, being the exclusive responsibility of the winners.
9.2 Participants in the Contest are not subject to any additional direct or indirect expenses, except for the normal expenses of conducting the Contest (the cost of accessing the Internet for registration in the Contest).
SECTION 10. LIMITATION OF LIABILITY
10.1 The Organizer is entitled to take all necessary measures in case of attempted fraud of the system, abuse, or any other attempts that could affect the image of this Contest, as well as of the Organizer. Any attempt at fraud results in the elimination of the Participant in question from the Contest, the Organizer informing the respective participant about this decision.
10.2 In the event of a dispute over the validity of an entry in this Contest, the decision of the Organizer is final.
10.3 The Organizer is not responsible for:
a) Recordings made outside the Contest period mentioned above;
b) Messages sent by the Organizer but not received by Participants for technical reasons or independent of the will of the Organizer;
c) Entries that do not contain all mandatory information;
d) Any disputes regarding the right of ownership of messages or their content;
e) Errors in the data provided by the Participant. The accuracy of the contact details does not entail the liability of the Organizer, being the sole responsibility of the participants. Therefore, the Organizer has no obligation in case participants provide erroneous data that have led to the impossibility of identifying the winner or awarding the prize;
f) The inability of winners to take possession of the prizes for reasons beyond the Organizer’s control;
g) Cases where the winner does not meet the validation conditions detailed in these Official Rules;
h) The Organizer shall not be liable for any damages suffered by the winner in connection with the prizes won, regardless of the nature of such damages, except for situations expressly provided by law that would establish such liability;
10.4 The Organizer shall not be liable in any way for direct or indirect damages resulting from participation in the Contest except in cases where they result from acts of gross negligence or intentional acts for which the Organizer is responsible.
SECTION 11. PROCESSING OF PERSONAL DATA
11.1 By participating in the Campaign, Players expressly and unequivocally consent to the Organizer processing their personal data free of charge during the Campaign for the purpose of conducting it. This includes enabling participant registration in the Contest, their inclusion in the Leaderboard, the possibility of them being designated as winners, and the awarding of prizes.
11.2 The following personal data will be processed:
a) For all Players: nickname and email.
b) For all Players designated as winners: bank account details, full name, personal identification number (CNP), and signature.
11.3 Refusal to disclose these data, providing incomplete information, or refusing their processing justifies the Organizer in refusing to award the prize. The Participant declared as the winner will thus be automatically disqualified.
11.4 The Organizer undertakes to comply with the provisions regarding the protection of personal data during the Campaign and thereafter. Thus, the Organizer commits to maintaining the confidentiality of the Players’ personal data in this Campaign and using them in accordance with this Official Regulation and applicable laws. The Organizer will not disclose the personal data provided by Participants to third parties without the prior consent of the Players concerned, except for names, first names, and the prize won, which will be made public in accordance with the Organizer’s legal obligations.
11.5 Player has the following rights:
(i) The right to access processed personal data;
(ii) The right to request the Organizer to rectify personal data;
(iii) The right to request the Organizer to delete personal data when they are no longer necessary for the purpose of organizing and conducting the Campaign;
(iv) The right to request the Organizer to restrict processing;
(v) The right to request the Organizer to transmit personal data concerning them in a structured, commonly used, and machine-readable format;
(vi) The right to object to processing, including for marketing purposes.
11.6 Requests/complaints regarding the processing of personal data related to the Contest can be submitted to the email contact@x-dolla.games, and if a Participant feels unjustly treated, they can contact the National Authority for Supervision of Personal Data Processing at www.dataprotection.ro.
SECTION 12. TERMINATION/INTERRUPTION OF THE CONTEST. FORCE MAJEURE
12.1 The Contest may cease before the expiration of the period provided in the event of an event constituting force majeure, including the impossibility of the Organizer, for reasons beyond its control, to ensure the smooth conduct of the Contest.
12.2 Force majeure means any event that cannot be foreseen, controlled, or remedied by the Organizer, including the impossibility of the Organizer, for reasons beyond its control, and whose occurrence renders it unable to fulfill its obligations under the Rules.
12.3 The Contest may also cease before the expiry of the established period or may be suspended at any time at the discretion of the Organizer, provided that it communicates such a situation in advance and complies with the provisions of the Rules.
SECTION 13. COMPLAINTS AND DISPUTES

13.1 Participants may file appeals regarding the conduct of the Contest through the contact form available on emag.ro within a maximum of 5 (five) days from the announcement of the winners. After this date, no appeal will be considered by the Organizer. Appeals will be resolved within 15 (fifteen) working days from the date of submission, and a written response will be communicated to the Participant at the email address provided or at the postal address communicated by the Participant.
13.2 Any disputes between the Organizer and Participants regarding any aspect related to the conduct of the Campaign will be resolved amicably, and if this is not possible, the disputes will be settled in the competent Romanian courts in the Municipality of Ramnicu Valcea.
