OFFICIAL RULES OF THE CONTEST
“xBasket Contest Champion 2”
Contest Period: December 1st , 2023(10:01 GMT+3) – April 1st, 2024 (10:00 GMT+3)
I. SECTION 1. CONTEST ORGANIZER
1.1 The organizer of the “xBasket Contest Champion 2” (hereinafter referred to as the “Contest”) is X Dolla Games S.R.L. (hereinafter referred to as the “Organizer”), a commercial company registered in accordance with Romanian law, with its registered office located in Dealu Aluniş, Berbeşti City, DANTULUI Street, No. 21, Block C38, Staircase A, Floor 2, Apartment 11, Vâlcea County, registered with the Trade Register under no. J38/647/21.07.2023, unique registration code RO 48526990.
1.2 Apple/Play Store is not a sponsor of this contest and is not involved in any way in this activity.
1.3 The prize value is not staked, awarded, or influenced by the game’s performance or chance-based results.
II. SECTION 2. CONTEST RULES
2.1. The contest will take place according to the provisions of these rules (“Rules”), which are mandatory for all Participants and all entities involved in the conduct of the Contest, in accordance with the provisions of Government Ordinance no. 99/2000 regarding the marketing of market products and services, with all subsequent amendments and completions.
2.2. The Rules are drawn up and made public in accordance with applicable Romanian legislation and are available, free of charge, to any participant, on https://x-dolla.games/terms-and-conditions-for-xbasket-contest-edition-2/ (english) and original document( https://x-dolla.games/termeni-si-conditii-concurs-xbasket-contest-editia-2/ ), as well as in the game where the contest takes place: “xBasket Contest: Win Real Money” (hereinafter referred to as the “Game”).
2.3. According to the Organizer’s free decision, the Contest may be publicized for the purpose of informing the public, including through advertising and/or informative materials. The information that such materials may contain will be interpreted in accordance with the provisions of these Rules.
2.4. The Organizer reserves the right to modify and/or supplement the Rules, as well as the right to suspend and/or terminate/extend the Contest, provided that the Participants are notified in advance of any change to any of its provisions. Any changes/supplements made to the provisions of these Rules will be included in additional documents that will be communicated to the public by updating the Rules and publishing, in updated form, on https://x-dolla.games/terms-and-conditions-for-xbasket-contest-edition-2/ english and original document (https://x-dolla.games/termeni-si-conditii-concurs-xbasket-contest-editia-2/), and participants will also be notified through the game.
2.5. Starting from November 1st, disqualifications will take place both during the contest and after the leaderboard snapshot. The reasons for disqualifications for each person will be made public through the in-game notification, as well as on the official organizer’s Twitter (https://twitter.com/X_Dolla_Games).
III. SECTION 3. CONTEST AREA AND DURATION
3.1 The Contest is organized online, in accordance with the provisions of these Rules, on the game xBasket Contest: Win Real Money for:

3.2 The Contest takes place from December 1st (10:01 GMT+3) to April 1st, 2023 (10:00 GMT+3).
IV. SECTION 4. RIGHT TO PARTICIPATE
4.1 All players (hereinafter referred to as “Players”) who have downloaded the xBasket Contest: Win Real Money game for Android or iOS for free and have an email and a bank account eligible to receive bank transfers from Romania automatically participate in the Contest without any fee.
4.2 Registration in the Contest implies the implicit, complete, express, and unequivocal acceptance of the provisions of these Rules.
4.3 The following categories of people do not have the right to participate in this Contest:
(i) Persons who are not eligible according to Section 4.1;
(ii) Employees of the Organizer, as well as affiliated companies* of the Organizer;
(iii) Employees of Agency/Agency 2 or employees of any other companies/entities involved in activities related to the organization and conduct of the Contest;
(iv) Players who have chosen an indecent, racist nickname,
(v) Players who have attempted in any way to cheat (reverse engineering, change date, etc.).
4.4 The Organizer reserves the right to take all measures to prevent participation, as well as the right to eliminate from the Contest any person in the categories mentioned in article 4.3.
V. SECTION 5. CONTEST MECHANISM
5.1 For a valid entry to participate in the Contest, the following conditions must be cumulatively met:
a) The Player must have the right to participate according to the provisions of Section 4 above;
b) A unique Player is identified based on the in-game nickname;
c) The Player must inform themselves in advance and in detail about any of the terms and conditions regarding the conduct of the Contest, in accordance with these Rules;
d) The organizer will ensure as much as possible that on the date of the snapshot the first 3 players in the ranking are eligible to receive the prize.
e) Winners will be contacted via email and will be asked to provide their real name, bank details, and address for receiving the prize.
5.2 All players will have 6 lives per day to use to enter as many baskets as possible and score the most points, which will be indexed in a leaderboard (hereinafter referred to as the “Leaderboard”).
5.3. The Leaderboard will reset at the beginning of each month at 10:00 GMT+3.
5.4. Players who rank 1st on the Leaderboard on the following calendar dates: January 1st, February 1st, March 1st, April 1st (09:00 GMT+3) will be awarded.
5.5 All inactive players for 30 days will be deleted from the database.
VI. SECTION 6. CONTEST PRIZES
6.1 Within the Contest, the following prizes will be awarded to players ranked 1st each month:
a. On January 1st, the prize will be $100 USD at the exchange rate offered by Banca Transilvania at the time of awarding the prize by bank transfer.
b. On February 1st, the prize will be $100 USD at the exchange rate offered by Banca Transilvania at the time of awarding the prize by bank transfer.
c. On March 1st, the prize will be $100 USD at the exchange rate offered by Banca Transilvania at the time of awarding the prize by bank transfer.
d. On April 1st, the prize will be $100 USD at the exchange rate offered by Banca Transilvania at the time of awarding the prize by bank transfer.
TOTAL PRIZE VALUE: $400 USD
6.2. The Organizer will not bear any additional expenses after awarding the winner.
VII. SECTION 7. ANNOUNCEMENT OF WINNERS AND AWARDING OF PRIZES
7.1 The prizes within the Contest will be awarded as follows:
At the beginning of each calendar month at 09:00 AM GMT+3, a snapshot of the Leaderboard will be taken, from which the data of the first player + 2 reserves consisting of the 2nd and 3rd places will be extracted.
If the winning player does not respond to the email within 24 hours, the player who occupies the 2nd place will be contacted. If the player in the 2nd place also does not respond within 24 hours, the player in the 3rd place at the time of the snapshot will be contacted.
VIII. SECTION 8. VALIDATION AND PUBLICATION OF WINNERS. RECEIVING THE PRIZES
8.1 After the designation of the winners, the Organizer will start the validation process, during which the fulfillment of the conditions regarding the registration of the Participants will be verified, as well as compliance with all provisions of this Regulation.
8.2 The player designated as the winner will be tagged in posts on Social Media channels (Twitter, Instagram).
8.3 Participants who have been designated as winners will be contacted exclusively by email from the following email address contact@x-dolla.games, to provide the bank details used exclusively for the awarding of the prize, and they must respond by email within a maximum of 24 hours from the moment of contact.
The Organizer reserves the right not to award the prize if the players designated as winners do not meet the validation conditions or if there are not enough participations in the Contest (minimum 10).
8.4. The prizes will be transmitted via bank transfer.
8.5. In the event that, due to reasons beyond the Organizer’s control, one of the validated winners to receive the prize informs the Organizer through the channels through which they were initially contacted, indicating that they cannot participate or refuse, the prize will not be awarded and will remain the property of the Organizer, who can dispose of it freely in the manner it deems necessary or appropriate to its interests.
8.6. The Organizer has no obligation to correspond with potential winners or prize winners after the expiration of the deadlines specified in this Regulation, or with other participants outside the obligations assumed by this Regulation.
IX. SECTION 9. TAXES AND TAXES
9.1. The Organizer undertakes to calculate, withhold, declare, and transfer the tax due for the income consisting of the prizes awarded to the winners in accordance with the provisions of art. 110 of the Fiscal Code approved by Law no. 227/2015, with subsequent modifications and completions, if applicable, any other obligations of any other nature, in connection with these, being the exclusive responsibility of the winners.
9.2. Participants in the Contest are not subject to any direct or indirect additional expenses, except for the normal expenses of conducting the Contest (the cost of Internet access for registration in the Contest).
X. SECTION 10. LIABILITY LIMITATION
10.1. The Organizer is entitled to take all necessary measures in case of attempted fraud of the system, abuse, or any other attempts that could affect the image of this Contest, as well as the Organizer. Any attempt at fraud results in the elimination of the Participant in question from the Contest, and the Organizer will inform the respective participant about this decision.
10.2. In the event of a dispute over the validity of an entry in this Contest, the decision of the Organizer is final.
10.3. The Organizer is not responsible for:
a) Registrations made outside the Contest period mentioned above;
b) Messages sent by the Organizer but not received by Participants for technical reasons or beyond the control of the Organizer’s will;
c) Entries that do not contain all mandatory information;
d) Any disputes regarding the ownership of messages or their content;
e) Errors in the data provided by the Participant. The accuracy of the contact data does not incur the responsibility of the Organizer, being the sole responsibility of the participants. Therefore, the Organizer has no obligation in case participants provide erroneous data that led to the impossibility of identifying the winner or awarding the prize;
f) The inability of the winners to take possession of the prizes due to reasons beyond the Organizer’s control;
g) Cases where the winner does not comply with the validation conditions detailed in this Official Regulation;
h) The Organizer will not be responsible for any damages that the winner may suffer in connection with the prizes won, regardless of the nature of these damages, except in cases expressly provided by law that would establish such liability;
10.4. The Organizer is not responsible in any way for direct or indirect damages resulting from participating in the Contest, except in cases where these are due to acts of gross negligence or intentional acts for which the Organizer is responsible.
XI. SECTION 11. PROCESSING OF PERSONAL DATA
11.1. Information regarding the processing of personal data carried out in connection with the conduct of this Contest is provided in Annex 1 of this Regulation. By participating in this Campaign, Participants agree that their personal data will be processed for the purpose of organizing and conducting the Campaign, by the Organizer as the data controller and by Agency and Agency 2 with the identification data in this, as authorized, for the processing of the data of the prize winners.
11.2. Requests/complaints regarding the processing of personal data in connection with the Contest can be submitted according to the indications and contact addresses provided in Annex 1 below.
XII. SECTION 12. TERMINATION/INTERRUPTION OF THE CONTEST. FORCE MAJEURE
12.1 The Contest may terminate before the scheduled period in the event of an occurrence constituting force majeure, including the Organizer’s inability, due to reasons beyond its control, to ensure the smooth conduct of the Contest.
12.2 Force majeure refers to any event that cannot be foreseen, controlled, or remedied by the Organizer, including the Organizer’s inability due to reasons beyond its control, and whose appearance puts the latter in the impossibility of fulfilling the obligations assumed by the Regulations.
12.3 The Contest may also cease before the established period or be suspended at any time at the Organizer’s discretion, provided that the Organizer communicates such a situation in advance and respects the provisions of the Regulations.
XIII. SECTION 13. OBJECTIONS AND DISPUTES
13.1 Participants can file objections regarding the conduct of the Contest through the contact form available on emag.ro within a maximum of 5 (five) days from the announcement of the winners. After this date, no objections will be considered by the Organizer. Objections will be resolved within 15 (fifteen) working days from the date of submission, and a written response will be communicated to the Participant at the email address provided or the postal address communicated by the Participant.
13.2 Any disputes arising between the Organizer and Participants regarding any aspect of the Campaign will be resolved amicably, and if this is not possible, the disputes will be settled in the competent Romanian courts in the Municipality of Ramnicu Valcea.
